Terms of Use
These Terms of Use govern your use of Glowmoji: AI Emoji Maker (the "App"). By downloading or using the App, you agree to these Terms and Apple's applicable App Store terms.
Eligibility
You must be at least 13 years old, or the minimum age required in your country, to use the App. If you are under the age of legal majority, a parent or guardian must review and accept these Terms for you. Do not use the App if you do not agree to these Terms.
What the App does
The App uses artificial intelligence to create emojis, stickers, and related images from text prompts, photos, reference images, styles, and other choices you submit. Results are generated automatically and may vary even when the same input is used.
License
The App is licensed, not sold. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use the App on Apple-branded devices you own or control, as permitted by the App Store usage rules and Apple's Standard End User License Agreement.
You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, interfere with, or attempt to gain unauthorized access to the App, except where applicable law does not allow that restriction.
Your content
You retain any rights you have in prompts, photos, and other content you submit ("Inputs"). You grant us and our service providers a limited, worldwide, non-exclusive license to host, reproduce, transmit, modify, and process Inputs only as needed to operate the App, create requested results, maintain safety and security, provide support, and comply with law.
You represent that you own or have all rights and permissions needed for every Input, including permission from people shown in photos. Do not submit confidential information or content that violates another person's privacy, publicity, copyright, trademark, or other rights.
Generated content
Subject to applicable law and third-party rights, you may use and share generated results for personal or commercial purposes. We do not guarantee that a result is unique, eligible for intellectual-property protection, accurate, or free from third-party claims. Similar or identical results may be generated for other users. You are responsible for reviewing a result and determining whether your intended use is lawful and appropriate.
Prohibited use
You may not use the App to create, upload, request, or distribute content that:
- is illegal, fraudulent, deceptive, threatening, harassing, hateful, or defamatory;
- sexually exploits or endangers a child or appears to depict child sexual abuse;
- violates privacy, publicity, intellectual-property, or other rights;
- impersonates a person deceptively or uses someone's likeness without required consent;
- contains malware, attempts to bypass safeguards, or disrupts the App or its providers; or
- is used for spam, scams, unauthorized surveillance, or other harmful activity.
We may block requests, remove access to content, limit usage, or suspend the App for violations, safety concerns, legal requirements, or abuse prevention.
Subscriptions and payments
Some features or generation allowances may require a paid subscription. Available plans, localized prices, billing periods, trial terms, and included features are shown before purchase. Payment is charged to your Apple Account through the App Store.
Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period. Your Apple Account may be charged for renewal within 24 hours before that period ends. Manage or cancel subscriptions in Apple Account subscription settings. Deleting the App does not cancel a subscription. Refunds are handled by Apple under App Store rules and applicable law.
Third-party services
The App depends on third-party services for AI processing, hosting, subscriptions, analytics, diagnostics, and content delivery. Those services may be unavailable, change, or apply their own terms and policies. We are not responsible for third-party services beyond what applicable law requires.
Intellectual property
The App, its software, design, text, graphics, branding, and non-user content are owned by us or our licensors and protected by applicable intellectual-property laws. Except for the limited license above, no rights in the App are transferred to you.
Feedback
If you voluntarily send suggestions or feedback, you allow us to use it without restriction or compensation, provided we do not publicly identify you without permission.
Availability and termination
We may update, change, limit, suspend, or discontinue features to improve the App, address safety or legal requirements, manage capacity, or reflect provider changes. Generation limits and availability may vary. Your license ends automatically if you materially violate these Terms. Provisions that by their nature should survive termination will remain in effect.
Disclaimer of warranties
To the fullest extent permitted by law, the App and generated content are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted availability. Nothing in these Terms excludes statutory consumer rights that cannot lawfully be excluded.
Limitation of liability
To the fullest extent permitted by law, we and our affiliates, officers, employees, licensors, and providers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, use, or goodwill, arising from the App or generated content. Where liability cannot be excluded, our total liability will not exceed the greater of the amount you paid for the App during the 12 months before the claim or USD $50, unless applicable law requires otherwise.
Apple terms
Apple is not responsible for the App or its support. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo and are not on a U.S. Government prohibited or restricted-party list.
Changes to these Terms
We may update these Terms as the App, our providers, or legal requirements change. We will post the updated version here and revise the effective date. Continued use after an update means you accept the revised Terms, to the extent permitted by law.
